A woman has filed a wrongful death lawsuit against Kiddie Academy. Her 4-month-old son was found unconscious while at their facility and later died.

The lawsuit states that Jeremy Davila was unresponsive and not breathing inside a crib while at the Kiddie Academy. The boy was put on his back to sleep for more than three hours.

Jeremy’s mother states that her son died due to negligence and inadequate supervision.  By law a child must be within a worker’s line of sight at all times. This did not happen the day Jeremy died.
