Two Settlements Reached in Plane Crash Litigation | Toledo, Ohio wrongful death attorney
Two families have settled in the wrongful death case involving a plane crash that killed 50 people. The crash occured on February 12, 2009 in Buffalo, New York. The families of John Roberts II and Darrin Tolsma are the first to receive their settlement in these cases. Trial for the other cases is set for March 2012. The claim in the families’ cases states that corporate decisions caused the pilot and the co-pilot to make a series of poor decisions.
The pilot in this case had previously failed two flight tests and the co-pilot had only made $16,000 in 2008. Investigation shows that the pilot failed to respond correctly to a cockpit stall warning and was to blame. The crew in the plane also failed to monitor the airspeed, which is the reason why the warning went off. Also found in the investigation were unnecessary conversations between the pilots.
The company Colgon’s lack of standard procedures also contributed to the crash. Colgon did not address the fatigue of the pilots either which was also a contributing facotr to the crash.
The settlement amount of these cases are being kept confidential.
