A car was driving down I-64 in Norfolk, VA when it started to have trouble with its tire. The vehicle  was forced to slow down to 25 mph. A tractor-trailor that was driving behind it failed to see this vehicle slow down and rear ended the car. Both vehicles caught fire and the young man, who was a passenger in the car, died.

The defense tried to argue that the vehicle in front of the truck driver did not have their hazards on even though they were driving at a very slow speed. They stated that this put the driver of the car at fault instead of the truck driver.

In return the plaintiffs argued that the truck driver had not been adequately treating his diabetes. They won the case and were awarded $3.5 million in settlement.
