2 brothers die in pool

The parents of two little boys who were found dead in an apartment complex’s pool have filed a wrongful death lawsuit against The apartment complex and the manager of the complex.

The lawsuit states that Victor Garcia, 7, and Cristubal Basurto Garcia, 5, drowned in the swimming pool at Cyprus Court Apartment Complex and says that the Defendants were negligent for not adequately preventing the children access to the pool as well as violation of ordinances and standards required under building codes in regards to swimming pools.

A 62-year-old woman crashes into a tree and dies

The Charles E. Boyk Law Offices sends their condolences to the family of 62-year-old Rebbecca Swan who lost control of her Chevy Malibu and hit a tree.

She was pronounced dead at the scene.

According to reports, neither road conditions or alcohol did not play a role in the crash.

Swan was not wearing a seat belt and was thrown from the vehicle when emergency crews arrived.

The cause of the crash is still under investigation.

Wrongful Death names bar as defendant

The family of Eric Benson has filed a wrongful death lawsuit against his attacker and the bar he was at before the assault.

Eric was killed in March of 2010 when William Googins made sexual advances to Benson’s friend. When Benson took offense, MR. Googins punched him, which caused Eric to strike his head on the ground. He died a few hours later.

The suit alleges that Oasis bar served Googins alcohol even though he was underage and visibly intoxicated. The lawsuit states that both William Googins and Oasis bar practiced negligence and recklessness that night.

Man dies after hospital forgets to remove pad after surgery

A wrongful death lawsuit has been filed against a hospital in Texas. The suit was filed by the wife of Kenneth Burns.

Mrs. Burns states that on April 21, 2010 her husband underwent surgery because of his acute diverticulitis of the sigmois segment of his colon. After the surgery, Mr. burns became unstable. His condition worsened and he was transferred to another hospital so that he could be better treated.

After arrival, a CT scan was performed and it showed a foreign body. When they went to remove it, a laparotomy pad was removed from Kenneth’s abdomen. Despite the intensive care and treatment, he passed away.

The evidence points to the laparotomy pad as the cause of the abdominal sepsis and that it ultimately led to Mr. Burn’s death.

The lawsuit states that “Kewanee Hospital failed to perform an accurate count of the surgical instruments, sponges, laparotomy pads, and other devices.” It also states that the care provided did not meet the standard of care required of reasonable, well-qualified surgical staff.

14-month-old boy Killed After Running into Street

14-month-old Ryan Brown was killed instantly after he was hit by 38-year-old Michelle A. Jones’s car.

Reports say Brown had run out of his home that sat off of the eastbound of the road when Jones who was traveling in the eastbound lane hit him.

Investigators are trying to find out exactly what happened that night and how he got out into the road. Once the report is completed it will be sent to the county prosecutor who will file charges, if necessary.
