Construction Workers Family Sue’s for His Death | Toledo Ohio Wrongful Death Attorney

The family of Javier Salinas, a construction worker who fell more than 50 feet and dead at the Chelsea Piers construction site has filed a wrongful-death lawsuit against Ashford Properties Construction Inc., and its parent company, the Ashford Company Inc.; Merritt Contractors Inc.; Stamford Exit 9 LLC; Chelsea Piers Connecticut LLC; American Building Group Inc.; and American Building Group LLC.

According to reports, the suit says that the contractors are responsible for the workers’ death because they allowed him to scale a roof of the Chelsea Piers sports complex without a safety harness.

Salinas fell to his death after a gust of wind blew him off the edge. He was working for American Buildings, a Trumbull contractor working for AP Construction, and was installing sheeting on the roof when he fell.

In early December, about 50 workers protested against AP Construction, claiming the construction company should be held accountable for hiring subcontractors who don’t cover worker’s compensation benefits and sacrifice safety in exchange for cost savings.

A stop-work order was issued by the state Department of Labor against the Trumbull subcontractor, American Building Group and two other construction companies.

Federal Occupational Safety and Health Administration officials are investigating the death.

A boat crash that killed four people on July 22 now has three wrongful death lawsuits that have been filed over the incident.

The parents of Matthew Simonson filed a wrongful death this past week over the death of their son. Matthew Simonson, 28, was one of the four people who died in a crash involving two boats.

The crash occurred about 9:45 p.m. It was the evening before the people on the boat were going to be in a wedding party.

After a fire on January 13 led to the burning down of the apartments at 3125 Meadowbrook Ct. near Central and Monroe in West Toledo and later the demolition of the building there was a body found inside that no one knew about. According to Toledo fire Chief Luis Santiago firefighters had swept every floor of the building for residents left in the building and they found and rescued 4 young boys were trapped in a second floor trapped. Witnesses that had seen the whole thing also said that everyone got out of the building. The building was considered a loss and for the safety of the community they had to demo the building.

12 hours later the body of Delano “Red” Fleming, 35, was found in his first floor apartment and this lead to the main question of how could they miss something like this? The family of Mr. Fleming is looking to answers along with the fire department and others to make sense of everything. They want to know if the fire department had done a thoroughly inspection of the building and if there was any type of evacuation plan set up for the building. There is an assessment of the incident ongoing right now and hopefully soon there will be answers for the family and friends of Mr. Fleming.

Family of compost worker files wrongful death | Toledo Ohio wrongful death lawyer

The wrongful death lawsuit that was recently filed alleges that the Lamont composting facility in which two brother inhaled fatal doses of toxic gas had extremely dangerous conditions.

The complaint states that Community Recycling acted in negligence and that the dangerous conditions were created by the company’s employees.

The lawsuit states that a man was cleaning out a drainage tunnel at the recycling plant when he inhaled hydrogen sulfide and was overcome. His brother saw him lying unconscious at the bottom of an underground shaft and went to rescue him, but he was overcome as well.

Community Recycling was cites with many land use violations , was ordered closed and fined $2.3 million.
