Document economic loss

Families can suffer a huge economic loss when a loved one dies due to an Ohio fatal accident. In order to prove the amount of that loss, our office hires an economist. Most economists are university professors who look at the decedent’s income level, the income they would have earned had they lived, prior tax returns, and other economic data to determine the value of the economic loss caused by the death.

In addition to having excellent academic credentials and real-world experience, an economist also must be a superb communicator with the jury.

A four-month-old boy suffered wrongful child death after the car seat he was riding in was ejected during a rollover car accident, according to a recent report by the Jere Beasley Report.

The Montana Supreme Court ruled that Evenflo, the car seat maker, was liable for the ejection and therefore the child’s tragic death, because its plastic seatbelt hooks were defective and prone to fracturing.

The family of the baby who lost his life was awarded $6.7 million in compensatory damages.

Claims in Ohio involving the death of a child PART 2 | Swanton, Ohio fatal accident lawyers

To prove the case in a negligence context, the executor must show that the defendant owed a duty of care to the child; that duty of care was breached; the breach caused the child’s injuries and death; and that the child’s estate and beneficiaries suffered damages.

The case must be proven by a standard called “preponderance of the evidence,” which essentially means that the evidence must tilt more in the favor of the executor than the defendant. Ohio wrongful death attorneys often explain the standard by telling jurors they just need to prove their case by 51 percent, which is well short of the reasonable doubt standard that we’ve all seen in television dramas depicting criminal trials.
