MI Supreme Court to hear arguments in 911 dispatcher case | Swanton Ohio wrongful death attorneys

The Michigan Supreme Court is expected to hear arguments about whether lawsuits against two 911 operators over their handling of calls from a 5-year-old boy should be dismissed.

Sharon Nichols was convicted of willful neglect of duty and served a year’s probation for her handling of the 5-year-old’s call on February 20, 2006.

Nicolas accused the boy of playing games and did not send help.  Robert called 911 again three hours later and was scolded again by Terri Sutton, another operator. Sutton did send police to the home.  Upon arrival, officers found 46-year-old Sherrill Turner dead from an apparent heart condition.

The charges against Sutton were dismissed.

Robert’s relatives sued, claiming wrongful death and intentional infliction of emotional distress.

Darvocet was an analgesic medication that was used to relieve pain.  It was commonly prescribed as part of treatment regimin to manage powerful conditions such as arthritis for example.  Darvocet is no longer on the market due to its powerful effects on the heart.  It was banned in 2010 by the FDA.

1. Darvocet is a combination of propoyxphene and acetaminophen.

2. Propoxyphene is about half to two-thirds as potent as codeine, but it can still be habit-forming.

3. Darvocet is supplied in various formations.

4. Since Darvocet contains acetaminophen, you must be careful about taking over-the-counter medications that also contain acetaminophen.

5. Alcohol should be avoided when taking Darvocet.

6. Darvocet can interact with other drugs causing serious sedation.

7. If you have any of the following pre-existing conditions, you should discuss taking Darvocet with your doctor.  You may require a dose adjustment or more careful monitoring.

8. Little information is known about the drug’s effects on a fetus.

9. If you experience any serious side effects while taking Darvocet, stop taking the drug and see emergency medical help.

10. There are common side effects associated with Darvocet that are less severe.

Darvon, Darvocet Banned | Toledo Ohio wrongful death lawyers

In 2010, the FDA banned Darvon, Darvocet and any other brand/ generic drugs that contain propoxyphene.  Propoxyphene is a safety-plagued painkiller from the 1950’s.

There was new proof of heart side effects in studies of healthy people taking normal doses of this drug.  There is an estimated 10 million Americans taking Darvocet and other variations of propoxyphene painkillers.  These users should not immediately cease usage because there is danger of serious withdrawal symptoms.  Rather than rapidly discontinuing use, patients should immediately contact their doctors for help switching to different methods of pain control.

The FDA’s action came almost six years after the U.K. banned the drug and a year and a half after the European Drug Agency banned it.

The drug puts patients at risk of abnormal or even fatal heart rhythm abnormalities said John Jenkins, MD, director of the FDA’s office of new drugs at the Center for Drug Evaluation and Research.

Sidney Wolfe announced in a press release that at least 1,000 to 2,000 people in the U.S. have died from using propoxyphene since the time the U.K. ban was announced.

Dal Pan says that people who have taken Darvocet, Darvon or other propoxyphene drugs for an extended period of time are not at increased risk of heart problems.
