The original case in trial court ruled that the state was not liable for the death of William Gardner that occurred  on Interstate 81 in Syracuse, NY. The ruling stated that state lacked the resources to fix the dangerous bridge even with prior knowledge of the bridge’s hazardous condition.

Last week however, the fourth department appellate court overturned the ruling and granted the Gardners judgment on liability.

The accident occurred when William Gardner skidded off a snowy bridge. This happened only 36 hours after a fatal car accident took place on the same bridge and in the same manner. The ruling states that,  “Only 2.1 inches of snow fell between the two accidents, including 0.2 inches that fell on the day of the decedent’s accident. There is no fair interpretation of the evidence that defendant’s response to a deadly condition by removing minimal snow and ice accumulations while failing to remove the snowbank that caused the fatality was reasonable.”

State Highway Trooper’s Widow Sue Ford | Toledo, Ohio wrongful death lawyer

On May 15, 2010 Patrick Ambroise was in his parked Ford Crown Victoria when he was rear ended. A vehicle veered onto the shoulder of the road and slammed into his car. The car then burst into flames and Mr. Ambroise died at the scene in the blaze on a Florida turnpike. Patrick was a 35 year old Highway Patrol Trooper.

The widow of Patrick and his two young daughters have filed a wrongful death claim and are seeking unspecified damages. The claim states that Ford sold poorly designed vehicles because of the placement of the gas tank. The gas tank placement makes the car more prone to burst into flames if rear ended.

Michigan Drunk Driver Kills Pedestrian | Bowling Green, Ohio wrongful death attorney

On August 13 around 4:30 pm Angel Wells, 28, was crossing the street in the crosswalk at the green light. She was on Alexis Rd near Bennett. At this time, Joseph Posadny of Temeperance was driving his pickup truck about 50-60 mph in a 45 mph zone. He ran the red light and struck Ms. Wells, killing her. Mr. Posadny was driving under the influence of alcohol at the time.

He was indicted by the Lucas County Grand Jury on September 10th with two counts of aggravated vehicular homocide and one count of failure to stop after an accident. He faces up to 15 years in prison if he is convicted.
