Leading Cause of Wrongful Death is Faulty Equipment | Toledo, Ohio wrongful death attorney

December 23rd, 2010 Author:

The statistics show that the main cause of wrongful death suits is a result of faulty equipment. The reason behind these may be design defects, in the manufacturing of the product, negligent maintenance or negligent equipment operation.

An example of a case involving faulty equipment occurred in 2003 and included a city park employee and a lawn mower. As a worker and operator of the lawn mower he had a right to expect that the mower would operate properly. In reality the mower had a defective parking brake. This caused the cable to corrode and break event though it was supposed to be covered in vinyl. The worker shut down the machine and got off. After he got off, the lawn mower started to roll away. In trying to stop the 6,000 pound machine he was run over. He died as a result of this accident.

Soccer Player Collapses, Doctor Sued in Wrongful Death | Toledo, Ohio wrongful death lawyer

December 20th, 2010 Author:

A doctor and his practice in Louisville, Kentucky are being sued in connection with the death of a nineteen year old. The lawsuit states that Bryce Turner received a physical in 2006 from Dr. Paige and the results showed  that he had a heart murmur. In spite of this, Bryce was given the go ahead to play sports, even though his condition could be life threatening. Dr. Paige failed to notify Bryce’s parents of the condition as well.

The doctor sent a letter in July of 2006 to the parents stating that their son was fit to play sports. Nowhere in the letter does it mention that he had found thickening of the heart muscle.

The incident happened on March 16, 2009 when Bryce was playing a recreational soccer game. He collapsed during the game and was rushed to the hospital where he was pronounced dead. He died from the thickening of his heart muscle.

The doctor had a responsibility to notify the parents at the time of the physical about the results. Proper follow up treatment should have also been set in place after the initial physical. Concorde Crash Verdict Reached | Toledo, Ohio wrongful death attorney

December 8th, 2010 Author:

The crash of a supersonic Concorde airplane that happened back in 2000 has reached a verdict. The crash killed 113 people in total. The French court ruled that Continental Airlines and a mechanic were both to blame for the accident. Both parties were fined and the mechanic, John Taylor, received a suspended prison sentence of 15 months for involuntary manslaughter.

Also found partly responsible was the aircraft manufacturer. The charges said that they should have reacted earlier to known design flaws of the airplane.

The Continental flight that took off shortly before the Concorde flight did was found to be the key role in why the Concorde flight did not make it. A titanium strip fell off of the engine of the DC-10 because it was improperly installed. When the Concorde hit the strip of titanium a wheel blew out sending debris up into the wing causing the fuel tank to rupture.

All parties involved here had a responsibility to make sure that everything was safe and installed properly and because they were not, 113 people died. If you have lost a loved one in a similar way you need help. Our Toledo, Ohio wrongful death lawyers can help you through this legal battle to get you the settlement you deserve.

December 2nd, 2010 Author:

The father of Michael Jackson has refiled a wrongful death suit against the doctor of his late son. In a seperate criminal matter the doctor, Conrad Murray, has pleaded not guilty to involuntary manslaughter.

Joe Jackson claims that there is still “much to discover” about Michael’s death, but that the main complaint against the doctor is the unhealthy administration of the drug propofol. Coroner’s blame Jackson’s death on the intoxication from this drug. Joe Jackson also claims that the pharmacy involved sold Dr. Murray excessive quantities of the drug, which is usually only used in a hospital setting.

Initial action on the case happened on June 25, the anniversary of Michael’s death, but a judge ruled that it should be filed in state court rather than federal court. The refiling occured on December 1, 2010.

Dr. Murray administered the drug to Jackson on the day that he died but claimed that it was to help him sleep and that he did not do anything wrong in the process.
