Man indicted in crash that killed two family members | Toledo Ohio wrongful death attorneys
The Lorain County Prosecutor’s Office has indicted a man they said was responsible for killing a mother and her young son while driving drunk.
Gerald Wetherbee Jr., 35, is facing charges of aggravated vehicular homicide, DUI, driving under suspension and more for the June 11 accident in the Village of Grafton.
The Elyria post of the State Highway Patrol said Wetherbee went left of center while traveling on state Route 83 and struck the Tomasheski family of four head-on.
36-year-old Tammy Tomasheski died at a nearby hospital soon after the accident while her son Tommy, 11, was pronounced dead at the scene of the accident.
Tom Tomasheski, a Lorain County Sheriff’s Deputy, and his daughter, Danielle, are still recovering after accident.
Troopers said Wetherbee’s blood alcohol level was more than twice the legal limit that night.
Tom Tomasheski said he’s come to terms with the passing of his wife and son. He said his faith and prayers helped him to live and those prayers look after his loved ones.
“Life can be taken away in just a split second,” Tom said, in an earlier interview. “You never really think about it in that effect. But your time could be up at any given moment.”
In an unrelated incident stemming from sex charges in 2005, Wetherbee was also indicted for failing to inform the sheriff’s department that he moved. He is a registered sex offender and now additionally faces tampering with records charges.
