Driver Brian McGurk, 40, was in his Ford Escape with friend Robert Kelly as he sped home from the Mets game on April 5^th. McGurk was intoxicated from the events as he plowed down 57-year-old Clara Almazo while she was coming home with her 8-year-old grandson from church services.

Almazo’s family filed a law suit accusing the death of their loved on on McGurk hit-and-run, the stadium vendors at Citi Field, and the Nurnberger Bierhaus, a local bar. Reports believe the bar and Citi Field are responsible for getting the fans too intoxicated to drive home that day when he collided with Almazo seconds after she pushed her grandson our of the way, saving his life.

Kayla Allen, Cleveland Ohio, was severely injured after a shooting rampage while at a suburban Cracker Barrel for her birthday. Allen had been shot at the Ohio restaurant by her father, Kevin Allen, along with her sister, Kerri, and mother, Katherina, who had died at the scene. Witnesses at the eatery reported the father selectively shooting at his family only with a shot gun. When Allen would not surrender after coming out of the building, officers opened fire and he died at the scene as well.

Kayla was the only survivor and in critical condition after the day’s events but still managed to hang on to life. However, after a month of being hospitalized and in hospice care, Kayla’s health took a turn for the worse and she was sent home to pass on peacefully in the comforts of her home.

“She has been surrounded by family and friends for the past few days, comfortable and serene,” the statement said. “This time has been most meaningful to us as we held her and loved her, prayed for her and said our goodbyes.”

Larry Green filed a two-page written lawsuit that he says could have prevented his 3-year-old daughter’s death against the Oklahoma’s Department of Corrections.

Green’s daughter, Erica, was born May 15, 1997, to Michelle Johnson who had been an inmate in prison for five weeks at the time the child was born. Johnson was serving for larceny charges at the time of the infant’s birth, and was reported to have a history of run-ins with the law for drug and child abuse. While serving her time, Johnson was allowed to place Erica in the care of a friend, Betty Brown. Erica was eventually returned to Michelle’s care after Brown was unable to care for the child. Michelle then allowed Harrell Johnson, her boyfriend at the time, to look after Erica while she was in prison.

Three years later in 2001, the headless body of an unknown 3-year-old was discovered in the woods near Kansas City. The infant’s body remained unidentified for four years and was referred to in the media as “Precious Doe”. It was later confirmed in 2005 that the infant body was Erica Green.

Justice was then served for the toddler in 2008 when Harrell Johnson admitted to abusing Erica Green while intoxicated and on drugs. After being beaten, kicked, and thrown to the ground, the toddler had died and was beheaded by Harrell with a pair of hedge clippers. Harrell then proceeded to dump the child’s body in the woods. Harrell Johnson was sentenced to 25 years in a state prison for second-degree murder in 2008.

Larry Green blames the fault of the toddler’s death on the prison and expects results from this incident. Green’s lawsuit announced prison officials “performed no background check whatsoever on Ms. Brown and failed to provide Ms. Brown with any guidance or standards as to the care, custody and possible future reunification of Erica Green with her parents”. Green’s lawsuit also claims officials were well aware of Michelle’s drug use while pregnant, refer to the birth of Michelle’s fourth child in 1995 that tested positive for cocaine proving great evidence that Michelle should not be a guardian and care for Erica.

On Saturday, a Connecticut teen was charged of negligent homicide after she struck a 44-year-old jogger with her SUV after failing to drive in the proper lane. The teenage girl was reported using her handheld cellular device on a bustling street when the accident occurred. The victim was avid runner Kenneth Dorsey from Norwalk who had been training for a marathon that fateful morning.

Distraction of the teen driver from her cell phone resulted in the death of Dorsey which has spurred the movement in the community for drivers to put down all mobile devices when behind the wheel. Leo Dorsey, father of the victim, stated on his son’s behalf that “There’s no reason to use a phone while you’re driving a car. There is nothing out there that important. I totally, totally have to believe that these phones can be made to shut off if they’re moving. I’m pushing for phones that don’t work when they’re moving.” Leo Dorsey expects the teen receives a severe punishment for the “stupidity” of her actions behind the wheel and is in hopes that “…her punishment is that she doesn’t forget. And maybe she passes that on to her friends and down the road to her own family.”

The death jogger Kenneth Dorsey has resulted in the arrest of the teen and if convicted, will face up to six months in jail on the negligent homicide charge. According to Connecticut’s state DMV, the charge of using a cellular phone under the age of 18 while driving carries a 30-day license suspension, a$175 in license restoration, and court fees for a first offense. Representation for the teen could not be immediately determined.

Close to 5,500 people across the country were killed and 448,000 were injured in vehicle crashes involving driver distraction in 2009 according to the National Highway Traffic Safety Administration. Also, of those distraction accidents, teens have been reported to be more likely than those in any other age groups to be involved in a fatal crash where distraction has been convicted.

Judge Meenu Sasser, Circuit Court, has thrown out a multi-million-dollar lawsuit a couple filed against the parents of a mentally disturbed man. Muriel and Jim Sitton were in hopes of creating a lawsuit against Michael and Carole Merhige who’s mentally disabled son Paul killed their daughter including three other family members in 2009 on Thanksgiving.

Palm Beach Post reports, “Attorneys representing the Sittons tried to persuade Sasser that the Merhiges were responsible for the murderous actions of their son, Paul, because they knew his mental illness had turned him into a powder keg.”

On that Thanksgiving Day, the Sittons were hosting dinner at their residence with Michael and Carole Merhige when suddenly Paul Merhige arrived. Paul then continued to retrieve a gun from his car and came into the house killing his twin sisters, Carla Merhige, Lisa Knight, and Makayla, the Sitton’s daughter. Raymonde Joseph, Muriel Sitton’s mother, was also shot in the bloody attack.

Judge Sasser ruled Monday the Merhiges’ son Paul is an adult and therefore they have no obligations to avert their son from hurting others; even if he was mentally impaired. However, Sitton’s attorneys counterattacked with the information that the Merhiges knew of their son’s rage and his threats on his sisters. The merhiges also knew their son Paul had discontinued his medication and his mental health was a risk to others.

In October, Paul Merhige pleaded guilty to the murders and is currently serving seven consecutive life sentences at the Lake Correctional Institution in central Florida which is focuses on helping the mentally ill. However, Jim Sitton is still unimpressed with the killer’s punishment and will fight to have Merhige put to death.

An outburst occurred around 9:45 a.m. in a second-floor hallway in Scott High School. According to Sgt. Joe Heffernan, none of the students were injured but he believes that some of the students had some neighboring associations that led police to believe that the outburst may have been quasi-gang related.

The police report said the students have been involved in previous “gang-related disturbances” both at and around the school grounds. There was also a fight in the street in front of the school last week.

Lori Olender, juvenile prosecutor, said four of the students were held in the community detention for the morning fight. All 10 of the involved students face safe school ordinance charges in juvenile court. The students are also must attend a school hearing and disciplinary action could include suspension or expulsion.

Due to the high level of gang activity in the community, school officials and Toledo police patrol the school area to deter fighting or other problems at school dismissal.

In January of 2011 the little boy exited the school bus and went to cross the street to go home. According to the lawsuit, the bus driver waited less than 5 seconds after he stopped the bus before it began moving again. On Wednesday, May 2, 2012, 13 people were charged for their roles in the hazing death of Florida A&M University drum major, Robert Champion, 26. Champion died aboard a chartered bus parked outside an Orlando Hotel, as a result of being severely beaten during a ritual.

According to authorities, Champion was severely beaten by band members in November and had bruises on his chest, arms, shoulder and back. Witnesses said that he had been vomiting before he was found unresponsive.

State Attorney Lawson Lamar has stated that 11 of the 13 people will face a hazing resulted charge, which is a third-degree felony. If they are convicted, each could face up to nearly six years in prison. The other two involved will face a misdemeanor charge.

It is possible that prosecutors will attempt to file more serious charges such as manslaughter and/or second-degree murder.

Kenneth Awls, 18 pleaded no contest to one count of complicity in the commission of attempted felonious assault. He served as the driver during a recent drive-by shooting. Awls was found guilty by Judge James Bates and is set for a June 12 sentencing date.
