The family of a molecular biologist at the University of Utah who was killed last August has filed a wrongful death lawsuit against the three men in the boat that ran her over while she was swimming.

Esther Fujimoto was an avid swimmer. She was in the Pineview Reservoir on August 21. She was swimming about 200 to 300 feet offshore when Robert Cole Boyer drover the boat over her. Skyler Shepher and Colton raines were the passengers in the boat.

The lawsuit state that the propeller tore into Ms. Fujimoto’s torso and lower abdomen, causing critical injuries. It was found that Boyer and raines had smoked marijuana prior to the accident and all three had consumed alcohol. After they hit Fujimoto they turned around to see what happened, but the left the scene offering no help.

The suit states that the three men failed their duty to use reasonable care to avoid an accident by operating the boat negligently, driving under the influence, failing to keep a proper lookout, failing to help Fujimoto after hitting her, and failing to get help for her.
