Wrongful-Death Suit Filed By Workers Family | Fremont Wrongful Death Attorney

February 10th, 2012 Author: Emmy

Javier Salinas’ estate has filed a wrongful-death lawsuit against the man’s employers, Ashford Properties Construction Inc., and its parent company, the Ashford Company Inc.; Merritt Contractors Inc.; Stamford Exit 9 LLC; Chelsea Piers Connecticut LLC. Salinas was a construction worker who fell more than 50 feet to his death at the Chelsea Piers construction site in Stamford, Connecticut. The lawsuit was filed in state Superior Court in Bridgeport on behalf of Salina’s widow contending that the contractors are responsible for his death because they allowed him to scale a roof of the Chelsea Piers sport complex without a safety harness. Salinas fell from the building after a gust of wind blew him over the edge. When he fell, he was working for American Buildings, a Trumbull contractor installing sheeting on the roof for AP Construction.

In early December, approximately 50 workers protested against AP Construction, claiming the construction company should be held accountable for hiring subcontractors who do not cover workers compensation benefits and sacrifice safety in exchange for cost savings. The state Department of Labor issued a stop-work order against the Trumbull subcontractor, American Building Group and two other construction companies. The Federal Occupational Safety and Health Administration officials are investigating the death.

College student crushed by elevator | Toledo Ohio wrongful death lawyers

January 19th, 2012 Author: Emmy

Andy Polakowski was the last of 24 people to enter the elevator on the third floor of his dorm room at Ohio State University. As he attempted to enter the service brake failed and the elevator began to descend while its doors were still open. He tried to jump out of the way and back into the lobby, but he was caught. Andy was crushed between the top of the car and the lobby floor. He died from his injuries.

In an investigation by the Ohio Department of Commerce revealed that the elevator’s capacity was supposed to be 3,150, but during a test the elevator’s brake failed at 2,500. Also found was that the brake-tension spring had been permanently set at its maximum adjustment and the load-weighing device was disconnected.

On behalf of Andy, his parents sued the university. The plaintiffs stated that the brake was improperly adjusted and maintained and that the accident was foreseeable the dorm’s elevators were slow moving and students frequently squeezed onto already full cars. they also said that the elevator should have been equipped with a device that would have prevented it from operating while overloaded and also should have had a rope brake, which would have prevented the car from dropping if the service break failed.
