Nate Kern loses life after Fremont Company roof collapses | Fremont, Ohio wrongful death lawyer

A Fremont man was killed after a roof collapsed yesterday at the Fremont Company in Fremont, Ohio.

The Fremont News Messenger reported that Nate Kern, a B&W Welding employee, was part of a group of employees who were replacing columns that support the roof on a 2,000-square-foot building when a 20-by-20-foot section of roof collapsed around 1:40 p.m.

B&W employees Mark Keckler and Todd Michael, as well as Fremont Company employee David Fisher were also hurt in the accident.

Damages available to beneficiaries in an Ohio wrongful death case PART 2 | Perrysburg, Ohio wrongful death attorneys

Under state law, there are five damages available to the beneficiaries.

The following are two of the five damages available to beneficiaries:

Loss of support – This refers to the lost earning capacity of the decedent had he or she not died. The factors taken into consideration for loss of support would be the salary at the time of the decedent’s death as well as the amount of money the decedent reasonably could have been expected to earn in the future had the death not occurred. Charts called “life tables” are used to calculate how long the decedent would have been expected to live based on such factors as age at the time of death, gender, and race.

Loss of services – Damages for loss of services are available to beneficiaries. It’s a sort of vague claim, but essentially the law allows beneficiaries to collect compensation for services the decedent provided the beneficiaries. For example, assume Betty was killed as the result of someone’s negligence. If Betty provided daycare for her daughter Leslie’s children, Leslie could seek compensation for the money it cost her to secure daycare. That’s not to say that the estate must show all the claimed lost services are attached to a specific dollar amount. The jury can determine a dollar figure for each lost service.

Filing a life insurance policy claim | Ohio wrongful death lawyers

Working through the process of grieving the loss of a loved one, while at the same time having to go through the claim filing process, can be one of the most difficult experiences of your life. The Insurance Department prepared the following information to help people in the filing of life insurance claims:

  • Obtain several copies of the death certificate. This is the standard documentation required for filing a life insurance claim.

  • Contact your lifine insurance agent. The agent who sold the policy can help fill out any necessary forms and act as an intermediary with the insurance company.

  • In the case of a group life insurance policy, such as coverage offered by an employer, first contact the group plan sponsor or the human resources office directly. If you are unable to contact the employer, contact the life insurance company directly.

  • Submit a certified copy of the death certificate from the funeral director with the policy claim.

In Ohio, companies are required by statute to pay interest on the death proceeds, from the date of death.
