The original case in trial court ruled that the state was not liable for the death of William Gardner that occurred  on Interstate 81 in Syracuse, NY. The ruling stated that state lacked the resources to fix the dangerous bridge even with prior knowledge of the bridge’s hazardous condition.

Last week however, the fourth department appellate court overturned the ruling and granted the Gardners judgment on liability.

The accident occurred when William Gardner skidded off a snowy bridge. This happened only 36 hours after a fatal car accident took place on the same bridge and in the same manner. The ruling states that,  “Only 2.1 inches of snow fell between the two accidents, including 0.2 inches that fell on the day of the decedent’s accident. There is no fair interpretation of the evidence that defendant’s response to a deadly condition by removing minimal snow and ice accumulations while failing to remove the snowbank that caused the fatality was reasonable.”

Family of Car Crash Victim Files Wrongful Death | Toledo, Ohio wrongful death attorney

The sons of Virginia Spalinger have filed a wrongful death suit for their mother. Virginia was 91 when she was killed in a car accident by a police officer. The case states that officer Daniel Miller was traveling at a high and dangerous speed without his lights and siren on when he struck Virginia, who was driving her 1965 Thunderbird. Mr Miller broadsided her when she turned left in front of him.

The case claims that the city was negligent because they failed to provide adequate training for police officers and also that they failed to adopt appropriate policies with regard to high speed pursuits.

The suit seeks $34,000 in economic damages and $500,000 for the family’s loss.

A wrongful death suit has been filed against Tyler Motor Co. for the death of one of their temporary employees on February 9, 2009.

The accident occurred when Andrew Frazier was driving a delivery truck from the defendant’s lot. When Mr. Frazier attempted a routine lane change from the middle lane of the highway, his truck began to hydroplane sideways. The truck collided with an oncoming pick up truck and as a result of the accident, Andrew suffered fatal injuries.

A car was driving down I-64 in Norfolk, VA when it started to have trouble with its tire. The vehicle  was forced to slow down to 25 mph. A woman was killed at the Salt Lake City International Airport recently. She was walking in the crosswalk toward the car rental area when she was struck by a vehicle.
