The parents of La’Derion Miller have separately filed lawsuits for the death of their son.  The 6 year-old kindergartener was tragically killed just over two months ago as he was trying to get on the bus to go to school.

Le’Derion was waiting at the bus stop with a young relative one morning before school. As he attempted to enter the school bus, the door shut and his jacket became caught in the door. He was dragged 80 feet before the bus driver noticed and stopped the bus.

Among the allegations the lawsuit states that the driver’s faults  were distractedness and inattentiveness, failure to follow safety guidelines, failing to maintain a line of sight, traveling at an unsafe speed and “not possessing the proper visual acuity and reaction time required of a school bus driver.”

The school board is accused of failing to require safety training programs about the loading and unloading of school bus passengers, failing to closely monitor school bus drivers for unsafe health issues and employing “a bus driver with visual acuity and reaction time deficits.”

The wife of Timothy Faulkner has filed a wrongful death suit against J.D. & Billy Hines Trucking Inc. and Charles Gwin. The fatal collision occurred in Texas on February 21. Timothy Faulkner and Charles Gwin were both driving tractor trailers on Highway 371 when Mr. Gwin’s collided into Mr. Faulkner.

Timothy Faulkner died as a result of the injuries he sustained from the truck accident. The plaintiff is seeking wrongful death damages, survival damages, court costs and interest.

On August 9th, 2010 a Japanese family was traveling in a tour van in Utah. They were on their way to see Bryce Canyon National Park as a part of their vacation. The inexperienced driver of the van was using energy drinks and caffeine gum to try and mask his fatigue. The driver eventually fell asleep causing a crash.

The family of Hiroki Hayase, 20, who was killed in the accident have filed a wrongful death suit against the driver as well as Canyon Transportation Inc. and Western Leisure Inc. for hiring a driver with less than two months of experience and for not having commercial requisite liability insurance.

Along with Hiroki two others were killed in the bus crash and 11 others were hurt including the family of Hiroki.
