A wrongful death lawsuit was recently filed against East Ohio Gas Company in Lake County. The lawsuit was filed by Frank Pitchler for the death of his wife on January 28, 2009. The lawsuit states that a plastic pipe inside a steel pipe was improperly used to connect the EOG gas line to the house. The plastic pipe then cracked allowing gas to enter the home.

The hazard in the home was tremendous and the mere turning on of a  kitchen appliance ignited the gas and caused a very large explosion. The entire house was destroyed along with all of the couple’s belongings. Frank was critically injured and his was died 18 hours later in the hospital. Furniture Store Explosion Leads to Wrongful Death Case | Toledo, Ohio wrongful death attorney

On December 29th in Michigan a man and a woman were killed in an explosion that occurred in a furniture store. The families of the two victims have filed a wrongful death suit against Consumers Energy, who supplied the gas to the furniture store and the surrounding neighborhood. Each family is seeking damages of at least $25,000.

The wrongful death case claims that Consumers Energy had taken two different calls from neighbors in the area complaining about the bad gas smell. These calls occurred at 6:40 and 7:40 am. Even after the calls were made there was no attempt to evacuate the neighborhood. At around 9 am that morning an explosion in the furniture store occurred. The explosion trapped the store owner and killed two of his employees.

The lawyers in this case state that  Consumers Energy violated a section of the Michigan Public Service Commission’s Michigan Gas Safety Standards that says, “If the investigation reveals a hazardous situation, then the operator shall take immediate action to evacuate, repair or isolate the facilities involved to reduce any danger to the public.”

Because they did not do this, Consumers Energy should be held responsible for their negligence that ended in the death of two and the hospitalization and burning of another.
