County Sued For Negligence in Death of Mentally Challenged Woman | Toledo, Ohio wrongful death lawyer

New York’s Erie County is being sued for failing to protect 23 year old Laura Collins. Laura was a mentally challenged woman who was killed by her mother and brother after years of abuse.

Last January Laura was found dead in her home with the cause of death being suffocation. Her mother has plead guilty to her murder.

Although the mother and half-brother are charged with the murder, further investigation showed that there had been repeated phone calls made to the Adult Protective Services division in the months before her death. The reports claimed that she was being abused, but the county found that the complaints were unfounded.

The county had a responsibility to protect Laura from the abuse that she was suffering. They failed to properly investigate the claims made. They never spoke to Laura outside the presence of her mother and never even entered the home. The negligence of the state failed to remove Laura from an abusive, harmful situation and because of it, she lost her life.

Soccer Player Collapses, Doctor Sued in Wrongful Death | Toledo, Ohio wrongful death lawyer

A doctor and his practice in Louisville, Kentucky are being sued in connection with the death of a nineteen year old. The lawsuit states that Bryce Turner received a physical in 2006 from Dr. Paige and the results showed  that he had a heart murmur. In spite of this, Bryce was given the go ahead to play sports, even though his condition could be life threatening. Dr. Paige failed to notify Bryce’s parents of the condition as well.

The doctor sent a letter in July of 2006 to the parents stating that their son was fit to play sports. Nowhere in the letter does it mention that he had found thickening of the heart muscle.

The incident happened on March 16, 2009 when Bryce was playing a recreational soccer game. He collapsed during the game and was rushed to the hospital where he was pronounced dead. He died from the thickening of his heart muscle.

The doctor had a responsibility to notify the parents at the time of the physical about the results. Proper follow up treatment should have also been set in place after the initial physical. Lawsuit Filed Against Bayer for Wrongful Death | Toledo, Ohio wrongful death lawyer

Portia Gray, the mother of the deceased Ra’Sean Gray, has filed a lawsuit against Bayer CropScience Institute for the wrongful death of her son.

Ra’Sean was a student at West Virginia University. In August of 2008 there was an explosion at Bayer which is near The University. That night there was a shelter-in-place order which told people to remain indoors. Mr. Gray did as he was instructed until they were given the clearace. When he went back to his dorm room after the order was lifted he found that his window was open and dust or soot was covering his room. He also stated that there was a foul smelling odor in his room.

 Ra’Sean had notified  The University several times after the incident and made at least one request for them to clean it. After the incident, on September 17 Mr. Gray made a trip to the ER because he was having trouble breathing. They treated and then released him. The next day he was admitted again and he died while in the hospital.

The wrongful death suit claims that Bayer failed to maintain its plant in a reasonably safe condition and failed to notify the public of the release of hazardous chemicals. The air monitors, which are designed to go off when hazardous chemicals are released into the air, were out of service the day the explosion happened.

Also named as co-defendants are The University of West Virginia and th State Board of Education because they were negligent in responding to Gray’s request.

Wrongful Death Lawsuit Filed Against Boeing | Toledo, Ohio wrongful death attorney

John Bruce worked as a ramp serviceman for United Airlines for more than two decades. In 2009 he accompanied a military flight from the United States to Kuwait International Airport. On top of a mobile belt loader, the 64 year old was removing cargo from the Boeing 747 when the operator of the belt moved it without warning, causing Bruce to fall 10 feet onto the Tarmac. Because of the fall he suffered severe brain injuries and was rushed to the hospital where he died six days later.

His widow, Cleopatra is suing Boeing for an unspecified amount of money in the wrongful death case for her husband. The case is filed in Cook County Circuit Court.

Columbus Pedestrian Dies From Crash Injuries | Toledo, Ohio wrongful death attorney

On Tuesday December 7, 2010 a man was walking down a street on the far east side of Columbus. Police say that the victim, 23 year old George Canfield was walking along Broad St. at 4:15 am. He was struck by a pickup truck driven by 57 year old Dennis Lowe.

Canfield was taken from the scene of the accident to a nearby hospital. He died at 8:00 am there at the hospital. Mr. Lowe was not injured from the accident.
